Terms & Conditions
Last updated: 1 September 2026
These Terms & Conditions (“Terms”) govern access to and use of the Brand Atlas website, platform, software, APIs, MCP, and related services (together, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Read this with our Privacy Policy and Cookie Policy.
1. About Brand Atlas
Brand Atlas is a trading name of Conscious Ventures Ltd (“Brand Atlas”, “we”, “us”, or “our”), registered in England and Wales under company number 13189124.
- Registered office: 139 Middle Deal Road, Deal, England, CT14 9RJ
- Email: hello@brandatlas.ai
2. Who these Terms apply to
Brand Atlas is designed for business and professional use. By using the Services you confirm that you are at least 18, have capacity to contract, and if you act for an organisation you have authority to bind it. “You” includes that organisation.
3. The Services
Brand Atlas is a control layer for commerce AI: one system of record for brand, products, and approved claims so AI tools can generate and send on-brand work.
Depending on your plan and configuration, the Services may include:
- brand profile and brand-book materials;
- knowledge ingest (sites, files, URLs, notes);
- product catalogue and related assets;
- claims libraries, copy and image checks, and an optional LLM gateway;
- on-brand image generation and related creative tools;
- Connect (MCP and API) so approved tools can use your brand context;
- integrations you enable (for example MailerLite or Webflow);
- credits for generation and compliance usage; and
- other features we make available in your workspace.
We may change or discontinue parts of the Services, provided we do not materially remove the core functionality of an active paid subscription without reasonable notice.
Claims, checks, and related tools are not legal, regulatory, or advertising-law advice. You remain responsible for what you publish and send.
4. Account registration and security
You must provide accurate information, keep credentials confidential, restrict access to authorised users, and notify us promptly of suspected misuse. You are responsible for activity under your account, including activity after Sign in with Google. If you use Google login, Google’s terms also apply to that sign-in.
5. Acceptable use
You must not (and must not allow others to):
- use the Services unlawfully, deceptively, or abusively;
- upload content that infringes others’ rights;
- input personal, confidential, or regulated data without the rights and legal basis to do so;
- upload malware or attack the Services;
- reverse engineer the Services except where prohibited restriction is unlawful;
- use the Services to build or train a competing product;
- resell or sublicense the Services without our written agreement; or
- remove proprietary notices.
We may suspend access if we reasonably believe you have breached these Terms.
6. AI features and output
Parts of the Services use AI and third-party model providers. Outputs may be incomplete, inaccurate, outdated, or unsuitable. They may not be unique. You must review outputs before publication or reliance. Brand Atlas does not provide legal, financial, tax, medical, or other regulated professional advice. You are solely responsible for use of outputs.
7. Customer Data
7.1 You retain ownership of data, files, prompts, URLs, brand materials, and other content you submit (“Customer Data”).
7.2 You grant us a non-exclusive, worldwide, royalty-free licence to host, copy, process, transmit, display, and use Customer Data only as reasonably necessary to provide, maintain, secure, and support the Services, and to prevent fraud and abuse.
We will not use your Customer Data to train our foundational artificial intelligence models.
7.3 You are responsible for Customer Data and for having all rights to provide it.
7.4 We may use technical logs, usage, and performance data for security, billing, support, and improvement. External disclosure of that information will be aggregated and/or de-identified unless law requires otherwise.
8. Privacy
Personal data is governed by our Privacy Policy. We may enter a data processing agreement where required.
9. Confidentiality
Each party will protect the other’s non-public Confidential Information with reasonable care and use it only to perform or receive the Services, with standard exceptions (public, already known, independently developed, or legally required disclosure).
10. Intellectual property
We and our licensors own the Services, software, designs, and related IP. Subject to these Terms and payment, we grant you a limited, non-exclusive, non-transferable right to use the Services during your subscription for internal lawful purposes.
Feedback may be used without restriction or compensation.
Subject to compliance with these Terms, you may use outputs generated for your account for your internal business purposes. That does not transfer ownership of the Services, models, or our pre-existing IP.
11. Third-party services
The Services may rely on Stripe, model providers, MCP hosts, Calendly, and integrations you connect. Those parties’ terms also apply. We are not responsible for third-party availability, security, or data practices. If a provider withdraws functionality, we may modify the affected feature.
12. Fees, credits, extra usage, and payment
12.1 Fees. You will pay the fees for the plan and usage you purchase. Unless stated otherwise, fees are in USD and exclusive of VAT. Stripe Tax may add applicable tax (including UK VAT) at charge time.
12.2 Subscriptions. Plans may be billed monthly or annually in advance. Providing a payment method authorises us or Stripe to charge the applicable fees.
12.3 Credits. Plans include generate and/or compliance credits as described at purchase. Credits are a usage meter for the Services, not cash, property, or a stored-value balance. Unused included credits expire at the end of the billing period unless we expressly state otherwise. Failed jobs may return credits to your allowance; that is not a money refund.
12.4 Extra usage (overage). If you enable extra usage, additional generate and compliance credits are billed after they are used, at the per-credit rate for your plan (the rate shown in the product at the time of use). Extra usage sits under one monthly spend cap that you set (subject to any maximum we publish).
- Nothing is charged for extra usage until extra credits are actually used.
- We invoice when unbilled extra fees reach USD 50 (ex-VAT), and we may also invoice remaining unbilled extra fees at period end, plan change, or cancellation (subject to the payment processor’s minimum charge).
- If an extra-usage invoice is unpaid, we may pause extra credits until it is paid. Included plan credits continue to work.
- Extra-usage fees already incurred remain payable if you cancel or change plan.
12.5 Renewals. Paid subscriptions renew automatically for successive periods equal to the then-current term unless cancelled before renewal.
12.6 Late payment. We may suspend the Services and charge interest or recovery costs to the extent permitted by law.
12.7 No refunds. Except where required by applicable law, all fees are non-refundable. This includes subscription fees, extra-usage (overage) invoices, and any other charges. If you cancel, cancellation takes effect as described in section 14. No refunds, credits against cash, or prorated reimbursements are given for unused subscription time, unused credits, or unused extra-usage allowance.
12.8 Trials. We may offer free trial credits or a time-limited trial. Trials are for eligible new customers unless we say otherwise. If a paid subscription is set to start after a trial and you provide a payment method, charges begin when the trial ends unless you cancel first. Promotional offers may be withdrawn; changes do not affect a period already paid for.
13. Availability and support
We will use reasonable care and skill. We do not guarantee uninterrupted or error-free service unless an Order Form says otherwise. We may suspend access for maintenance, security, legal compliance, non-payment, or misuse.
14. Term and termination
14.1 These Terms start when you first use the Services and continue while you use them or maintain a subscription.
14.2 Termination by you. You may cancel through the product or by emailing hello@brandatlas.ai. Where you use in-product delete subscription / delete workspace, cancellation of billing is immediate, the workspace and stored files are deleted, integrations are disconnected, and you will not be charged for future subscription periods. This is not a refund of amounts already paid or extra-usage already incurred. Unpaid invoices remain due.
14.3 Termination by us. We may suspend or terminate immediately for material breach, non-payment, legal/security risk, or legal requirement. We may discontinue the Services on reasonable notice.
14.4 Effect. Your right to use the Services ends. Unpaid fees become due. We may delete the account and Customer Data after a reasonable retention period, subject to legal holds and backups.
15. Warranties and disclaimers
We warrant we will provide the Services with reasonable care and skill. Otherwise the Services are provided “as is” and “as available.” To the fullest extent permitted by law we disclaim implied warranties including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that outputs will be accurate, that claims checks will catch every issue, or that use of the Services will achieve any particular commercial result.
16. Limitation of liability
Nothing excludes liability that cannot legally be excluded (including death or personal injury caused by negligence, or fraud).
Subject to that:
- we are not liable for indirect, incidental, special, or consequential loss;
- we are not liable for loss of profits, revenue, business, goodwill, anticipated savings, or data;
- we are not liable for third-party providers outside our reasonable control; and
- our total aggregate liability arising out of the Services or these Terms will not exceed the total fees you paid us for the Services in the twelve months before the claim.
17. Indemnity
You will indemnify Brand Atlas and its officers, employees, and contractors against claims arising from your Customer Data, your breach of these Terms, your infringement of third-party rights, your use of outputs, or your processing of personal data in violation of applicable law.
18. Publicity
We may use your name and logo to identify you as a customer. You may opt out by written notice to hello@brandatlas.ai, after which we will stop using your branding in future public materials.
19. Changes
We may update these Terms. Material changes will be posted with an updated date and, where appropriate, other reasonable notice. Continued use after the update takes effect is acceptance.
20. General
These Terms, the Privacy Policy, Cookie Policy, plan details, and any order form are the entire agreement. You may not assign without our consent; we may assign in a corporate transaction.
